Proposed Rules

The following are summaries and other information related to Proposed Rules that the Missouri Department of Revenue has submitted to the Secretary of State for Publication in the Missouri Register. These rules will not go into effect until the public has had an opportunity to submit written comments, and to attend a public hearing if one is scheduled.

Any person may offer comments on a Proposed Rule. The instructions for submitting comments, and the location and date of a hearing if one is scheduled, are located after the text of each rule. Please note that the official text of a Proposed Rule is the version that appears in the Missouri Register, not the draft copy on this site. Refer to the official copy if you wish to submit comments.

Proposed Amendment 12 CSR 10- 24.305 This proposed amendment modifies language to include a requirement for new and upgrading commercial license applicants to complete the required written testing and obtain a commercial learnerís permit and hold such permit for a minimum of fourteen (14) days prior to completing driving skills testing as defined by changes to section 302.720, RSMo, and sections 49 CFR 383, 384, and 385 in the Commercial Driverís License Testing and Commercial Learnerís Permit Standards rule (Docket No. FMCSA-2007-27659).   Proposal,

Proposed Amendment 12 CSR 10- 24.330 This proposed amendment requires third-party testers to maintain a security bond and to submit test results through a secure electronic means as defined in 49 CFR 383 in the Commercial Driverís License Testing and Commercial Learnerís Permit Standards rule (Docket No. FMCSA-2007-27659). Proposed Rescission 12 CSR 10- 24.385 This rule established the types of school bus permits issued to school bus operators. This rule is being rescinded because it is outdated and the statutory references to the issuance of a school bus permit have been deleted. Proposed Amendment 12 CSR 10- 24.390 This proposed amendment defines that an applicant for a commercial driver instruction permit must first hold a valid Missouri driver license as defined in section 49 CFR 383.71 of the Commercial Driverís License Testing and Commercial Learnerís Permit Standards rule (Docket No. FMCSA-2007-27659). Proposed Amendment 12 CSR 10- 24.395 This proposed amendment requires that commercial driver license test scores are submitted through a secure electronic means to the Department of Revenue to be consistent with federal requirement 49 CFR 383.135 and 49 CFR 384.229.   Proposal March 16, 2015 Volume 40, Number 6   03/16/2015
Proposed Rescission 12 CSR 10- 24.442 This rule established that a second or subsequent disqualification for a serious traffic violation or for driving while out of service shall be in addition to any other previous period of disqualification as stated in 49 CFR section 384.219. This rule is being rescinded because the provisions of House Bill 103, enacted by the 97th General Assembly (2013), changed section 302.755, RSMo, to mirror the federal regulations regarding stacking of disqualifications; therefore, this rule is no longer needed.   Proposal March 16, 2015 Volume 40, Number 6   03/16/2015
