Department Announces Filing of Candidate Affidavit of Tax Payments is Approaching

        JEFFERSON CITY – The Department of Revenue (Department) announced today that as the first date for filing as a candidate in the August 5, 2008 primary approaches, many questions have been raised about the process and time frame for filing the Candidate’s Affidavit of Tax Payments with the Department.

        If a qualified Missourian desires to file as a candidate for election to a public office in Missouri, except those offices exempt pursuant to Section 115.305 RSMo, the Candidate’s Affidavit of Tax Payments (Form 5120) must be filed with the Department.  In the Affidavit, the candidate will state he or she is not delinquent in the payment of any state income taxes, personal property taxes, or real property taxes on his or her place of residence as stated on the declaration of candidacy, and that he or she is not a past or present corporate officer of any motor vehicle and driver license contract office (also called a fee office) that owes any taxes to the state.

        The candidate must complete all information requested on the Affidavit and have the Affidavit notarized.  The original Affidavit must be filed with the Department. A copy of the Affidavit must be attached to the candidate’s declaration of candidacy filed with the Secretary of State or local election official, if applicable.  The candidate should obscure or remove his or her Social Security number from the copy of the Affidavit attached to the declaration of candidacy.

        The Affidavit form can be obtained from the Department’s web site at www.dor.mo.gov. Questions concerning whether a particular candidate is required to file an Affidavit or other related questions should be directed to the Secretary of State’s Elections Division at (573) 751-2301.

        Candidate filing begins on February 26, 2008, at 8:00 a.m. and filing closes on March 25, 2008, at 5:00 p.m.  Full filing information can be found on the Secretary of State’s web site at www.sos.mo.gov.
