Driver Licensing Law Changes
Effective August 28, 2008
SENATE BILLS 930 & 947
School Bus Endorsements
- Applicants age 70 and over renewing a CDL or Class E license with an “S” endorsement will have the license and skills test fees waived (the $2.50 office processing fee will still apply).
- The driver must still submit proof of completion of a school bus skills test at the time of renewal.
Utility Vehicles
- Defines “utility vehicle” as “any motorized vehicle manufactured and used exclusively for off-highway use which is sixty-three inches or less in width, with an unladen dry weight of 1,850 pounds or less, traveling on four or six wheels, to be used primarily for landscaping, lawn care, or maintenance purposes.”
- Provides that utility vehicles cannot be operated upon the highways of this state unless they are:
- Owned and operated by governmental entity for official use,
- Operated for agricultural or industrial on-premise purposes, or
- Operated by handicapped person for short distances on secondary roads.
- The operator must have a valid driver license, but does not have to be motorcycle qualified.
- Allows cities to issues special permits for utility vehicles to be used on county roads within the county to licensed drivers for a fee of $15. The fee is to be kept by such county.
- States that the seller is responsible for collecting and remitting all applicable state and local tax on new utility vehicles.
- Utility vehicle owners may qualify for a “farm use” tax exemption.
Instate Failure to Appear Suspensions
- Requires that upon compliance and applicable reinstatement fees, “Instate Failure to Appear Suspensions” be removed from a driver’s record.
Senate Bill 1139
First Person Consent/Organ and Tissue Donor Registry
- The Missouri Organ and Tissue Donor Registry is now a first person consent registry, making the applicant’s decision final and family consent no longer required.
- If the applicant responds “Yes” giving his/her consent, the license verification sheet will include a new affidavit statement for the applicant to review and certify to when signing the verification sheet.
- Upon printing, the permit, driver or nondriver license will include a new symbol (red heart with green banner and the word DONOR above the heart) in the bottom-left corner of the license. It will post to the bottom-right corner for those less than 21 years of age.
- If the applicant responds “Yes” giving his/her consent, the license verification sheet will include a new affidavit statement for the applicant to review and certify to when signing the verification sheet.
House Bill 1549
CDL Written Test
- Requires that the commercial driver license written test must only be administered in English, and that translators will not be allowed for applicants taking the test.

SENATE BILL 82
MILITARY APPLICANTS
- Allows active-duty armed forces members (temporarily mobilized and deployed outside of Missouri) to obtain a new, renewal, or duplicate permit/driver/nondriver license through a power of attorney when required documentation is submitted.
- Waives CDL skills test for qualified active duty or retired military applicants. Detailed requirements are listed on form DOR-5140

TOW TRUCK OPERATORS
- Creates a four point municipal ordinance driver license conviction for tow truck drivers who stop or proceed to the scene of an accident without permission (302.302).
Effective January 1, 2007
DRIVING INSTRUCTION REQUIREMENTS
- Instruction Permit holders must receive 40 hours of behind the wheel driving instruction (currently, 20 hours is required), including a minimum of 10 hours of nighttime driving instruction that occurs between sunset and sunrise.
Effective August 28, 2006
Intermediate License Restrictions
Intermediate License holders are subject to the following new driving restrictions:
- During the first six months, applicants may not operate the vehicle with more than one passenger under 19 years old who is not a member of the applicant’s immediate family.
- After the first 6 months, applicants may not operate the vehicle with more than three passengers under 19 years old who are not members of the applicant’s immediate family.
These restrictions may not be applicable to an Intermediate License holder who is operating in agricultural work-related activities.
Immediate family includes parents, grandparents, brothers, sisters, stepbrothers, stepsisters, and adopted or foster children residing in the driver’s household. Parent includes a foster parent, stepparent, or adoptive parent. Grandparent includes a foster grandparent, step-grandparent, or adoptive grandparent. Changes In ID Requirements
Missouri law requires all applicants to show proof of lawful presence, proof of identity, and proof of residency before a permit, driver license, or nondriver license can be issued. All applicants must present and surrender their current permit, driver license, or nondriver license, in addition to providing proof of lawful presence. Exceptions: Missourians age 65 or older who are renewing a driver license or nondriver license are NOT required to show proof of lawful presence. Additionally, any Missourian under age 65 without proof of lawful presence may obtain a one-year license IF a 15 year Missouri driving history exists. The special one-year license cannot be renewed, but does provide a full year to obtain the required documents for proof of lawful presence.
